Here we go again. We are now going through plenty of blunders in opening statements by the Senators. From Republican Tom Coburn’s statement about our “Constitutional Democracy” to Schumer and Feinstein showing that they do NOT KNOW the Constitution, or “…don’t care about it in instances like this.”
Feinstein and Schumer railed over the Supreme Court decision in McDonald v. Chicago where Justice Alito wrote:
“We have previously held that most of the provisions of the Bill of Rights apply with full force to both the Federal Government and the States. Applying the standard that is well established in our caselaw, we hold that the Second Amendment right is fully applicable to the States.”
Well, duh. They had to. That is why the framers of the Constitution added the Bill of Rights BEFORE THEY WOULD SIGN IT. I kinda get the impression that the founding fathers felt that it was “incorporated” to the States.
Anyway, the Democrats hold that the Constitution is so-much toilet paper since it stands in the way of Communism. The Republicans the rights of Americans except where it interferes with the Patriot Act.
The confirmation hearing for the Solicitor General Elena Kagan begins today. If you don’t have cable or need to catch up after work, you can see the results of the day on C-SPAN.ORG. The hearings begin at 12:30 ET.
Kagan is expected to hear court cases such as the Arizona Sanction laws upheld by the 9th Circuit court and written pretty much out of the Federal immigration law which she opposes.
