King seeks to issue a cease-and-desist order on an Executive Order.

Republican Representative Peter King of New York has introduced legislation to defund Executive Order 13166. Executive Order 13166, Improving Access to Services for Persons with Limited English Proficiency, was signed into law unconstitutionally by Bill Clinton on August 8, 2000.

Representative King gained notoriety for his alleged inflammatory hearings on the terrorist activities of Muslims.

H.R. 1307 would nullify the E.O. and provide that, “No funds appropriated pursuant to any provision of law may be used to promulgate or enforce any executive order that creates an entitlement to services provided in any language other than English.”

The preamble to the Executive Order reads, “By the authority vested in me as President by the Constitution and the laws of the United States of America, and to improve access to federally conducted and federally assisted programs and activities for persons who, as a result of national origin, are limited in their English proficiency (LEP)”

There is no constitutional provision for the president to declare laws.

Among the goals of this law is, “The Federal Government provides and funds an array of services that can be made accessible to otherwise eligible persons who are not proficient in the English language.”

E.O. 13166 requires that, “Each agency providing Federal financial assistance shall draft title VI guidance specifically tailored to its recipients that is consistent with the LEP Guidance issued by the Department of Justice. This agency-specific guidance shall detail how the general standards established in the LEP Guidance will be applied to the agency’s recipients.”

In July of 2008, Obama derided Americans for not learning to speak Spanish and other languages; as he has on border security and other issues.
