Open letter to Arizona Attorney General Tom Horne: prosecute the ATF people responsible for Fast and Furious under state law

Dear Mr. Horne

As you are aware, ATF ran a program called “Fast and Furious” out of their Phoenix office whereby the let assault rifles “walk” into the hands of the Mexican drug cartels and various border bandits.

Two of those ATF “walked” guns, which were sold by a Phoenix area gun shop with the knowledge of ATF, were found at the murder scene of Border Patrol agent Brian Terry.

While various investigations are on-going at the federal level, there appear to be important state law issues involved in this situation.

I specifically call your attention to Arizona Revised Statutes Title 13 Section 1201 “Endangerment”

13-1201. Endangerment; classification

A. A person commits endangerment by recklessly endangering another person with a substantial risk of imminent death or physical injury.

B. Endangerment involving a substantial risk of imminent death is a class 6 felony. In all other cases, it is a class 1 misdemeanor.

Twelve Democratic senators have joined 45 Republicans in a fast growing movement to halt progress on an Obama-backed United Nations effort that could bring international gun control into the United States and slap America’s gun owners with severe restrictions.

Montana Democratic Sen. Jon Tester’s office today provided Whispers with their letter, signed by 11 other Democrats, urging the president to press for significant changes in the treaty. Their major concern: that domestic manufacture, possession, and sales of firearms and ammo will be included, thereby giving an international authority the right to regulate arms sales already protected by the Second Amendment. They also said any move for an international gun registry would be a non-starter. [See editorial cartoons about the Democrats.]

A Republican letter circulated by Kansas Republican Sen. Jerry Moran has 45 signatures.

Ratification requires two-thirds of the Senate. So far 57 senators have said they would vote against the treaty, expected to be wrapped up next year.

In his letter, Moran wrote, “Our country’s sovereignty and the Second Amendment rights of American citizens must not be infringed upon by the United Nations,” Moran wrote in the letter. “Today, the Senate sends a powerful message to the Obama Administration: an Arms Trade Treaty that does not protect ownership of civilian firearms will fail in the Senate. Our firearm freedoms are not negotiable.”

Mass. gun-maker to pay $600K in gun-death lawsuit

BOSTON (AP) — A Massachusetts gun-maker has agreed to pay nearly $600,000 to the families of one man who was killed and another man who was wounded in a shooting involving a gun allegedly stolen from the company, a national gun-control group announced Tuesday.

Danny Guzman, 26, was slain outside a Worcester nightclub in 1999. Armando Maisonet was wounded in the same shooting.

In a 2002 wrongful death suit against Kahr Arms, of Worcester, Guzman’s family alleged that the gun was stolen and later sold by a Kahr employee with a criminal record.

The Brady Center to Prevent Gun Violence announced the settlement in Washington, D.C., calling it the largest damages payment ever made by a gun manufacturer accused of negligence leading to the criminal use of a gun.

Last week’s NPR interview on “Tell Me More” really should be called “Tell Me Less”. Their heavy editing of only The Radiance Foundation’s perspective, while preserving every word spoken by Reverend Carlton Veazey,revealed NPR’s typical liberal bias and uninformed defense of Planned Parenthood. The Religious Coalition for Reproductive Choice CEO’s closing remarks (nearly two minutes versus mine which were cut down to 15 seconds) were just a continuation of pro-abortion histrionics by the historically challenged.

Veazey was unwilling to address the epidemic of abortion in the black community, even denying Planned Parenthood’s entire history rooted in the racist pseudoscience of eugenics. He played the role so clearly defined by Margaret Sanger’s original Negro Project back in 1939, using black pastors to propagandize on her behalf. Margaret Higgins Sanger Slee was a grand manipulator and strategist, with a veritable war chest from her second husband, Noah Slee, an oil tycoon.

Many of her aggressive and repulsive eugenics-based efforts were funded by organizations sympathetic with her Birth Control crusade. One of those population control entities was the Ford Foundation, which also funds the Religious Coalition for Reproductive Choice (RCRC) and pro-abortion activist groups like SisterSong, both staunch defenders of Planned Parenthood. Money was never an obstacle for Sanger and her fellow eugenicists. However, ideological resistance, rooted in Christian faith, was.

Generally speaking, you probably won’t see this in Arizona except, perhaps, for Phoenix and Tuscon. This “officer” has violated several rights including “judging” that a “citizen” should not judge on the scene. The officer, also, did not advise the person of his rights.

For Arizona citizens, non-felons are allowed to carry a concealed weapon in Arizona without a permit. YOU MUST, however, INFORM AN OFFICER IF HE STOPS YOU THAT YOU ARE CARRYING. He may HOLD THE WEAPON FOR THE DURATION OF THE STOP. Most police and sheriff’s deputies in Arizona will allow you the time to tell them.

I don’t know about Ohio, but it doesn’t seem legal to threaten to “execute” a citizen. Obviously innocent until proven guilty (in a court of law) means nothing in Canton.

There is little argument that the job is dangerous especially at night. When the police, however, who are supposed to be in control get out of hand, we have a problem.

One thing I might point out to victims of these crimes is to shut up. The only thing that you should say after being handcuffed is “I want to see a lawyer.”

Over the past few months, I have been studying various papers written by the Federalists and Anti-federalist who bickered back-and-forth in the newspapers concerning whether or not the Constitution of the United States should be adopted. In case you were unaware, the Federalists were the “good guys” who won and got the Constitution accepted. The Anti-federalists were the “bad guys” who only succeeded in getting that useless Bill of Rights added to the Constitution.

The most notable Anti-federalist were Thomas Jefferson, Patrick Henry and George Mason. There were many others that wrote about the problems with the Constitution under various pseudonyms, such as Brutus and Cato. Many people of the time had a fair idea of who they were by their style of writing and the newspapers in which their writing appeared.

When people speak of the “Federalists Papers,” they are usually referring to those written by the top three; John Jay, James Madison and Alexander Hamilton all writing under the name of Publius. There were others, though, that wrote under other pseudonyms.

While searching for information concerning this argument, I happened across a file that I downloaded on my computer from Project Gutenberg some months ago. The original was edited by Paul Leicester Ford and published in 1892. After receiving a copy, I set about to continue editing the book. The very first series of papers included in this volume were rather stunning. Thus, I have decided to share my book learnin’ with you.

The first series of letters were written under the name of Cassius and accredited to James Sullivan of Massachusetts. He was the 7th governor of Massachusetts. He was Irish and on that count I will simply relate that he spoke his mind. He was defiantly a Federalist. He wrote a series of eleven articles. The first seven articles were a scathing review of the opinions of Anti-federalists. In particular, Numa, Vox Populi—or rather Vox Insania—and Agrippa. His writing shows that he had a certain disdain for each of these individuals who e’er they were.

At the announcement of the nomination of Richard Cordray for director Consumer Financial Protection Bureau, Obama cracked a joke and he was the only one laughing. Republicans plan to filibuster the nomination out of Washington.

Big deal.

A government “Consumer Financial Protection Bureau” does not instill confidence in citizens of States who have watched their money stolen by men without masks to be turned over to banks and foreign governments by the Federal Reserve in the form of TARP. In the middle of the budget showdown, these idiots in Washington are hiring someone for a useless job. What is this Consumer Bureau going to do about the Federal Reserve which has purposely caused our current third world economy?

Well, we don’t think casino magnate Steve Wynn will be attending any President Obama fundraisers in Las Vegas.

Wynn blasted Obama on a recent conference call with investors, saying business people are sitting on their money out of “fear of the president.”

“I’m telling you that the business community in this company is frightened to death of the weird political philosophy of the President of the United States,” Wynn said. “And until he’s gone, everybody’s going to be sitting on their thumbs.”

Seems that the idea of Vice Mayor John Kocjan to change the name of Page, Arizona to something to do with Lake Powell died as quickly as I hope his political career does.

He is quoted in the Arizona Daily Sun as saying, “People ask me where I’m from and I tell them, ‘Page.’ They say, ‘Where?’ I’ll say, ‘Lake Powell,’ and they’ll say, ‘I know where that is’.”

I was born in Page while my father built that lake. We don’t need to change for every Californian that does not know the geography of Arizona. Why don’t you all just go back to California and stay there.

PHOENIX—People on both sides of the immigration debate in Arizona are skeptical of new research that shows a national decrease in the flow of illegal immigration from Mexico into the United States. But there is one thing they are certain of: undocumented immigrants are steering clear of the border state.

“I think they are just avoiding Arizona,” said Jesse Hernández, a real estate agent who works in the Maryvale neighborhood where the exodus of immigrants, due to the crackdown on illegal immigration and the implosion of the housing market, is especially visible. “They are going to California and other places. No matter how much worse things are in the US, they are still coming over here. It’s a human interest to look for a better opportunity.”

The survey, conducted by Douglas S. Massey, co-director of the Mexican Migration Project at Princeton University, showed that interest in migrating to the United States from Mexico has dropped and the net flow has gone to zero for the first time in 60 years. Apprehensions of Mexicans along the border have also fallen by 70 percent in the last 10 years.

Mark Krikorian, director for the Center of Immigration Studies (CIS), a Washington, D.C.-based conservative think-thank that advocates for less immigration, is also skeptical that the trend of migration could be changing.

On June 30, QE2 ended with a whimper. The Fed’s second round of “quantitative easing” involved $600 billion created with a computer keystroke for the purchase of long-term government bonds. But the government never actually got the money, which went straight into the reserve accounts of banks, where it still sits today. Worse, it went into the reserve accounts of FOREIGN banks, on which the Federal Reserve is now paying 0.25 percent interest.

Before QE2 there was QE1, in which the Fed bought $1.25 trillion in mortgage-backed securities from the banks. This money, too, remains in bank reserve accounts collecting interest and dust. The Fed reports that the accumulated excess reserves of depository institutions now total nearly $1.6 trillion.

H.R.2417, the Better Use of Light Bulbs Act—introduced by Joe Barton of Texas’ Sixth District on July 6—failed a vote today.

The bill would have prevented any regulation for energy efficient bulbs that would limit the sale and use of bulbs to only those containing mercury.

5 of the 238 “Yea” votes were Democrats while 10 Republicans voted against the measure.

Mercury is also the same substance used in vaccines given to your children.

Bloomberg is reporting that new administration rules have gun dealers ONLY in Arizona, California, New Mexico and Texas reporting anyone who purchases two or more semi-automatic weapons with detachable clips to the ATF.

You know, the guys that sold guns to the drug cartel in Mexico.

Since all federal gun regulations are unconstitutional—according to Senators Feinstein and Schumer—we don’t need to go there.

According to FOX News,

“In an effort to stem the illicit flow of weapons into Mexico, the Justice Department announced Monday that all gun shops in four Southwest border states will be required to alert the federal government to frequent buyers of high-powered rifles.

Under the new policy, federal firearms licensees in Texas, California, Arizona and New Mexico must report purchases of two or more of some types of rifles by the same person in a five-day span. The requirement applies to purchases of semi-automatic rifles that have detachable magazines and a caliber of greater than .22.

ATF estimates it will generate 18,000 reports a year. ATF will retain the information and if no investigative leads have been realized after two years, it will be purged.”

Just like TSA, ATF is now authorized to database information on gun owners without evidence of a crime and without a search warrant. They will hold this profiling effort on gun owners for two years after which, “…it will be purged.”

Not only is that a lie, it’s unconstitutional, as well. The Fourth Amendment protects you against unreasonable searches and seizures. Now they will have an absolute list of gun owners from which to work.

The next step, of course, is to have retail outlets report when you purchase two or more light bulbs within a five-day period.

In an article entitled “GunWalker” at the III Percent Patriots blog, Kerodin III wrote an article beginning with, “Most of you know I rarely comment of GunWalker because I consider it a useless Sparklie.”

In the article, he writes, “Consider: Every ATF Agent who let guns walk, who let Americans purchase firearms without interference, whether they knew it or not, were following 2A.” His article contends that those who are beating the drum against the ATF are actually working against the Second Amendment.

Allow me to start by pointing out a few things. Kerodin III is probably not his real name. Liberals like to cry See! He didn’t even use his real name! I only point this out because it shows their ignorance to their own history. The Federalist and Anti-Federalist used pseudonyms when arguing whether or not the Constitution should even be adopted. Kerodin III is simply following his founding father’s example and using a pseudonym does not distract one iota from his opinion. In addition, I understand the principle of the “3-percenters,” and respect their opinions.

In this case, however, I must respectfully disagree with this writer.

We must understand what the “GunWalking” scandal is really all about. We first heard about it when we heard how Arizona gun dealers were delivering fully-automatic weapons by the truckloads to the drug cartel in Mexico City. Or so the Obama administration would have you believe. Now we learn the truth. Gun dealers in Arizona were told to sell the weapons to known illegal buyers by the ATF. Those same gun dealers were vilified by that very agency. To this day the Mexican government and lame stream media perpetrates this farce every time a bust is made.
