The Obama administration has been ignoring federal immigration laws in failing to deport thousands of illegal aliens as they have been identified and detained. And now that defiance of federal law has resulted in the murder of three people, one of which was a 15 year old girl.
In 2006, 23 year old Kesler Dufrene from Haiti, was convicted of his second felony for burglary. A judge in Bradenton, Florida sentenced Dufrene to five years in prison. Since he was also an illegal immigrant, his felony conviction caused an immigration judge to order that he be deported back to Haiti upon his release from prison.
Dufrene was released from prison in September, 2010 and handed over to immigration officials. In October 2010 and under the directions from Obama who ordered a temporary halt to deportations to Haiti due to the massive earthquake that devastated the island nation, Dufrene was released from custody by immigration officials. Even though he was a two time felon and an illegal alien, Dufrene was free to walk the streets of Florida.
Citing Article I, Section 5 (sic)[This should probably be Section 8], Clauses 4 and 18 of the United States Constitution, Representative Darrell Issa of the 49th district of California submitted HR-45 entitled the Criminal Alien Accountability Act. The act would change 8 U.S.C. 1326 to provide stiffer penalties for aliens reentering the U.S. or committing crimes while in the U.S. The only cosponsor of the bill is Representative Brooks of Missouri. No Arizona representative cosponsored the legislation.
This title applies to aliens who:
(1) has been denied admission, excluded, deported, or removed or has departed the United States while an order of exclusion, deportation, or removal is outstanding, and thereafter
(2) enters, attempts to enter, or is at any time found in, the United States, unless
(A) prior to his reembarkation at a place outside the United States or his application for admission from foreign contiguous territory, the Attorney General has expressly consented to such alien’s reapplying for admission; or
(B) with respect to an alien previously denied admission and removed, unless such alien shall establish that he was not required to obtain such advance consent under this chapter or any prior Act,
The bill would add stiffer mandatory sentencing for these aliens. Changes in Subsection B are:
Paragraph 1 would read: “whose removal was subsequent to a conviction for commission of three or more misdemeanors involving drugs, crimes against the person, or both, or a felony (other than an aggravated felony), such alien shall be fined under title 18, imprisoned not more than 10 years, imprisoned for a term of not less than 5 years and not more than 10 years or both;”
Paragraph 2 would read, “whose removal was subsequent to a conviction for commission of an aggravated felony, such alien shall be fined under such title, imprisoned not more than 20 years, imprisoned for a term of not less than 10 years and not more than 20 years or both;
(4) who was removed from the United States pursuant to section 1231 (a)(4)(B) of this title who thereafter, without the permission of the Attorney General, enters, attempts to enter, or is at any time found in, the United States (unless the Attorney General has expressly consented to such alien’s reentry) shall be fined under title 18, imprisoned for not more than 10 years, imprisoned for a term of not less than 5 years and not more than 10 years or both.
The last change would probably be moot since the Attorney General has opened the way for drug traffikking and human smuggling by attacking Sheriff Joe Arpaio of Maricopa county stopping the efforts of the Sheriff to enforce these laws. The report of the justice department complains of the Sheriff’s Office “profiling,” yet they have not investigated the profiling done in their own office or that of the DHS concerning “domestic terrorists” that carry a copy of the Constitution or have a Ron Paul sticker on their car.
The bill would add a provision for persons who knowingly assist an alien to reenter:
Any person who knowingly aids or assists any alien violating section 276(b) to reenter the United States, or who connives or conspires with any person or persons to allow, procure, or permit any such alien to reenter the United States, shall be fined under title 18, United States Code, or imprisoned for a term imposed under paragraph (2), or both
The bill was introduced in January of 2011 and referred to the Subcommittee on Immigration Policy and Enforcement in February where it languishes. The bill would probably have to be resubmitted in the next session of Congress if is to ever see the light of day.

PHOENIX – The Maricopa County Sheriff’s Office said Wednesday night that ICE refused to take custody of 10 admitted illegal immigrants — 2 of whom are children.
The subjects allegedly told deputies they were in the country illegally and were on their way to New York.
When deputies contacted ICE to turn them over, they reportedly refused. MCSO contacted Border Patrol, which agreed to take custody.
However, deputies have to drive the subjects down to Casa Grande.
PHOENIX—People on both sides of the immigration debate in Arizona are skeptical of new research that shows a national decrease in the flow of illegal immigration from Mexico into the United States. But there is one thing they are certain of: undocumented immigrants are steering clear of the border state.
“I think they are just avoiding Arizona,” said Jesse Hernández, a real estate agent who works in the Maryvale neighborhood where the exodus of immigrants, due to the crackdown on illegal immigration and the implosion of the housing market, is especially visible. “They are going to California and other places. No matter how much worse things are in the US, they are still coming over here. It’s a human interest to look for a better opportunity.”
The survey, conducted by Douglas S. Massey, co-director of the Mexican Migration Project at Princeton University, showed that interest in migrating to the United States from Mexico has dropped and the net flow has gone to zero for the first time in 60 years. Apprehensions of Mexicans along the border have also fallen by 70 percent in the last 10 years.
Mark Krikorian, director for the Center of Immigration Studies (CIS), a Washington, D.C.-based conservative think-thank that advocates for less immigration, is also skeptical that the trend of migration could be changing.
In Thursday’s case, Chief Justice John Roberts said the 2007 Arizona law penalizing companies that hire illegal immigrants meets a “licensing” exception to the general federal rule dictating that states not set their own civil or criminal penalties in the immigration area.
WASHINGTON —The Supreme Court on Thursday upheld an Arizona law that revokes the business licenses of companies hiring illegal immigrants, in a closely watched case testing state efforts to stop people from crossing the border.
By a 5-3 vote, the court rejected arguments from a coalition of business and civil rights groups, including the Chamber of Commerce and ACLU, that the Arizona law conflicts with overriding federal immigration policy and could lead to race discrimination.
“I don’t think anyone was invited who was interested in stopping illegal immigration,” Gallegly said.
WASHINGTON — Rep. Elton Gallegly said Tuesday that a White House meeting between President Barack Obama and people who want to overhaul the nation’s immigration system was really just “a summit on amnesty.”
“The list of people he had there were obviously people who were not concerned about stopping illegal immigration,” the Simi Valley Republican said.
Obama and several administration officials met Tuesday with about 70 people who want to change immigration laws in what the White House described as an effort to foster “a constructive national conversation” on immigration reform.
The guest list, a diverse group of elected officials and religious, business, labor and civil rights leader, included former Gov. Arnold Schwarzenegger, New York City Mayor Michael Bloomberg, Los Angeles City Council President Eric Garcetti, the Rev. Al Sharpton and former Commerce Secretary Carlos Gutierrez.
Several told reporters afterward that Obama assured them he would continue pushing for a new immigration policy. Garcetti said Obama also indicated he would press for a vote on a bill to help certain undocumented immigrants attain legal status if they attend college or serve in the military.
Reporting from Ensenada—The immigrants heard the engine slow as the pilot steered through breakers. Twelve hours earlier, they had shoved off from a beach near Ensenada. Now, they were bobbing off Red Beach at Camp Pendleton. Out in the darkness, California beckoned.
“Jump out!” barked the pilot.
The 17 immigrants climbed over the side of the rickety boat, stumbling and splashing their way through the surf where U.S. Marines usually charge ashore in armored vehicles during amphibious assault exercises.
“I couldn’t run because I had been sitting in the boat for so long,” said Maribel Ruiz. “But the pilot kept yelling, ‘Run! Run! Run!’ It was terrible.”
On February 10, 2011, Prince William County police arrested Jose Oswaldo Reyes Alfaro, 37, after he allegedly went on a shooting and stabbing spree which left three people dead and three others wounded. When he was taken into custody, the Salvadoran national had in his possession, a machete as well as a .38 caliber revolver.
The two separate attacks occurred only a few blocks apart.

According to Manassas Police Chief Doug Keen, the suspect was ordered deported in 2002, but was never detained by federal immigration authorities and never left, despite two more arrests after his deportation order.
The United States government is funding the National Council of La Raza with our tax dollars. La Raza, which literally means in Spanish “The Race,” is a radical organization that advocates open borders and amnesty for illegal aliens. According to the 2008 tax returns seventeen people listed as officers, directors, trustees, key employees and highest compensated employees of the National Council of La Raza have an income ranging from $119,675 to $378,446, the latter of which goes to Janet Murguia, president and CEO.
WASHINGTON — Republican representative Darrell Issa of the 49th district of California, has submitted H.R. 45, the Criminal Alien Accountability Act. The bill was submitted January 5 and currently has no cosponsors.
The bill is “To amend section 276 of the Immigration and Nationality Act to impose mandatory sentencing ranges with respect to aliens who reenter the United States after having been removed, and for other purposes.”
The bill would change certain mandatory sentencing laws concerning criminal aliens in the United States. Specifically, it adds minimum sentences in three areas where they do not exist now.
A Republican legislator is pushing for a state law cutting off public housing benefits for undocumented immigrants even though the U.S. Department of Housing and Urban Development already requires applicants to prove citizenship or legal residency.
Sen. Andy Biggs, R-Gilbert, the sponsor of SB 1222, said Arizona has the right to enforce its own requirement.
“We have to take back our state because our federal government is no longer the federal government, it is the national government,” he said Wednesday to fellow members of Senate Government Reform Committee. “And this bill is an assertion by the state to take back its rights.”
U.S. border authorities have arrested a controversial Muslim cleric who was deported from Canada to Tunisia three years ago and was caught earlier this month trying to sneak into California inside the trunk of a BMW, according to court documents.
Said Jaziri, the former Imam of a Muslim congregation in Montreal, was hidden inside a car driven by a San Diego-area man who was pulled over by U.S. Border Patrol agents near an Indian casino east of San Diego. Jaziri allegedly paid a Tijuana-based smuggling group $5,000 to get him across the border near Tecate, saying he wanted to be taken to a “safe place anywhere in the U.S.”
The arrest marks the unexpected resurfacing of the 43-year-old cleric, whose protracted legal battle to avoid deportation drew headlines in Canada. A Tunisian immigrant, Jaziri was deported for failing to disclose a criminal conviction in France while applying for refugee status in the mid-1990s.
But Jaziri’s supporters said he was targeted for his fundamentalist views: Jaziri backed Sharia law for Canadian Muslims and led protests over the publication of the prophet Muhammad cartoons in a Danish newspaper in 2006.

Homeland Security Secretary Janet Napolitano touched down in Afghanistan on Friday morning and planned to spend New Year’s Eve visiting troops.
Six Department of Homeland Security (DHS) customs and border security officials will accompany Napolitano on the weeklong trip, which will include stops in Qatar, Israel and Belgium.
Napolitano spent Friday morning touring Afghanistan’s Torkham Border Crossing with Pakistan and meeting with Afghan an U.S. border security and customs officials to find new ways to establish a border-security and customs system to counter terrorism while allowing legitimate travel and trade.
The never-say-die Democrats are forcing through another vote on the Dream Act by attaching it to H.R. 5281, Removal Clarification Act of 2010. The Democrats want to ensure a new flood of voting Democrats prior to the 2012 election.
